These Terms apply to consumer and business purchases, subject to mandatory legal provisions. Certain protections also apply to qualifying sole-trader purchases under Polish law.
2. Online Store Services
The website provides electronic services including browsing products, using the shopping cart, placing orders, contacting the seller and, where available, registering and managing customer accounts.
Access to the website requires an internet connection and a browser capable of supporting modern web standards, secure HTTPS connections and essential session cookies.
Electronic services associated with browsing and account management are generally provided free of charge. Internet or telecommunications charges imposed by third-party providers remain the customer's responsibility.
Customers must not use the website unlawfully, submit unlawful content, compromise its security or interfere with its operation.
The agreement for maintaining a customer account continues until the account is closed in accordance with the customer's request and applicable law. Customers may request account closure by email. Information required for accounting, contractual or legal purposes may be retained for the applicable period.
Technical complaints concerning electronic services can be submitted to info@vintagegear.eu and will be handled in accordance with applicable law.
3. Products and Vintage Equipment
Vintage Gear offers new, pre-owned and vintage musical equipment.
Many vintage instruments are several decades old and may contain original components, replacement parts or earlier modifications.
Normal signs of age and use may include cosmetic wear, changes in component appearance or other characteristics described in the individual product listing.
We aim to disclose known relevant faults, repairs and modifications.
The product description, photographs and individually agreed specifications form part of the information provided before purchase.
A vintage instrument's age or used condition does not automatically exclude statutory consumer rights.
For technical questions or additional information, customers may contact us before ordering.
4. Prices and Taxes
Product prices are displayed in the currency selected on the website.
Applicable taxes and the total amount payable are presented before the customer submits an order.
Delivery charges and any other applicable additional costs are disclosed before the purchase is finalized.
For unusually large or fragile items requiring individually arranged transport, the final delivery cost may be provided through a separate quotation before the customer commits to the purchase.
For deliveries outside the European Union, additional customs duties, import taxes or customs clearance charges may apply according to the destination country's regulations. Customers will be informed of known applicable arrangements before completing their purchase.
5. Ordering and Contract Formation
Customers select products, review their shopping cart and provide the information necessary for fulfilment and delivery.
Before placing an order, customers can review the information entered and correct errors.
Submission of an order through the checkout constitutes an order involving an obligation to pay when the relevant checkout button clearly indicates that obligation.
Receipt of the order is acknowledged electronically.
The sales contract is concluded when Vintage Gear confirms acceptance of the order by email.
For purchases requiring individually agreed transport arrangements, the total price and delivery conditions must be agreed before the order is finalized.
Contractual information and order details are provided electronically.
The contract is concluded in the language in which the relevant ordering process and contractual information are made available.
6. Payment
Available payment methods are displayed during checkout or agreed individually where a product requires a separate quotation.
The customer is informed of the total price payable before completing the order.
Payments must be completed in accordance with the selected payment method.
If an order cannot be fulfilled after payment has been received, the seller will arrange an appropriate refund in accordance with applicable law.
7. Shipping and Delivery
Vintage Gear supplies musical instruments, replacement parts and related products to supported delivery destinations.
Smaller products may be shipped using postal or courier services.
Heavy, fragile or unusually large instruments, including vintage electric pianos and organs, may require specialist transport.
Where available, direct door-to-door transportation may be arranged to reduce unnecessary handling.
Delivery charges, available shipping methods and estimated delivery times depend on the destination, dimensions, weight and nature of the product.
Any individually arranged delivery terms will be communicated before the purchase is finalized.
The seller remains responsible for the goods during transport to the extent required by applicable consumer law.
Customers are encouraged to inspect deliveries and promptly report visible transport damage. Failure to report damage immediately does not remove statutory consumer rights.
8. Right of Withdrawal
Consumers purchasing goods online generally have the right to withdraw from the contract within 14 days, without giving a reason, subject to statutory exceptions.
The withdrawal period normally starts when the consumer, or a designated third party other than the carrier, receives the goods.
For an order delivered in several separate shipments, the period generally begins upon receipt of the final item or shipment.
To exercise the right of withdrawal, the consumer must inform the seller through an unequivocal statement before the withdrawal period expires.
The statement may be sent by email to:
Or by post to:
ECHO – Tomasz Radecki
ul. Główna 102A
55-010 Święta Katarzyna
Poland
The model withdrawal form at the end of these Terms may be used but is not mandatory.
After notifying the seller of withdrawal, the consumer must send the goods back without undue delay and no later than 14 days after the notification, unless the seller has agreed to collect them.
Before returning a heavy or fragile instrument, customers are encouraged to contact Vintage Gear to arrange appropriate transportation.
The consumer generally bears the direct cost of returning goods following withdrawal where the required cost information was provided before purchase.
For goods that cannot normally be returned by post, estimated return transportation costs must be disclosed before the contract is concluded.
Refunds are made without undue delay and within 14 days after the seller receives notification of withdrawal.
The seller may withhold reimbursement until the goods have been received or the consumer provides evidence of dispatch, whichever occurs first, where permitted by law.
Refunds include the original standard delivery cost, but not additional expenses resulting from choosing a more expensive delivery method than the least expensive standard method offered.
Refunds are issued using the original payment method unless the consumer expressly agrees otherwise, without additional charges.
The consumer may be responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Important: The statutory right of withdrawal generally applies to vintage and second-hand instruments sold online. Age, rarity or pre-owned condition alone does not remove this right.
Statutory exceptions may apply, including certain goods made to the consumer's specifications or clearly personalized, where the relevant legal conditions are met.
9. Complaints and Statutory Consumer Rights
Consumers have statutory rights when purchased goods do not conform to the sales contract.
Under Polish consumer law, the seller is generally responsible for a lack of conformity existing at delivery and revealed within two years from delivery, subject to applicable statutory rules.
Consumers may request repair or replacement and, in circumstances provided by law, a price reduction or termination of the contract.
A complaint can be submitted by email:
Or by post:
ECHO – Tomasz Radecki
ul. Główna 102A
55-010 Święta Katarzyna
Poland
Customers are encouraged to provide a description of the problem and sufficient information to identify the purchase.
Photographs or videos may help establish the nature of the problem, but providing them is not an absolute condition for submitting a complaint.
A receipt is not the only acceptable proof of purchase.
Consumer complaints are answered within the statutory period, generally 14 days from receipt.
Repair, replacement, collection and transportation costs arising from a justified statutory conformity claim are borne by the seller as required by law.
For rare or unique vintage instruments, an identical replacement may be unavailable. In such cases, the remedies available are determined by the applicable legal provisions and the circumstances of the case.
Any additional commercial warranty does not replace or restrict statutory consumer rights.
10. Vintage Instrument Characteristics
Vintage musical instruments may require more frequent servicing or specialist maintenance than modern equipment.
Age-related characteristics expressly and specifically disclosed in the product description may be relevant to the assessment of conformity.
The existence of ordinary vintage characteristics does not automatically exclude liability for defects or a lack of conformity.
Any specific technical requirements, compatibility concerns or restoration expectations should be discussed before purchase.
Descriptions such as "vintage", "restored" or "pre-owned" must be understood in conjunction with the individual product information.
11. Repairs, Restoration and Rental Services
Vintage Gear may provide information about additional services such as instrument servicing, restoration or rental.
Where offered, these services may require separate agreements covering the scope of work, price, duration, delivery, liability and other relevant conditions.
An enquiry alone does not constitute confirmation of a service agreement.
Any separate agreements remain subject to applicable law and mandatory consumer rights.
12. Personal Data
Personal data submitted during registration, ordering or communication with Vintage Gear is processed in accordance with applicable data protection legislation, including the GDPR where applicable.
The data controller is:

Information about the purposes, legal bases and periods of data processing, as well as individuals' rights, is provided in the store's Privacy Policy.
13. Intellectual Property
Website content, including original photographs, descriptions and graphics, is protected by applicable intellectual property laws where relevant.
Third-party product names and trademarks remain the property of their respective owners.
Customers may use the website and its content for lawful personal and shopping purposes.
14. Consumer Disputes
Customers are encouraged to contact Vintage Gear directly if a dispute arises.
Consumers may seek assistance from competent consumer protection authorities or use available out-of-court dispute resolution procedures.
Information about consumer rights in Poland is available from the Office of Competition and Consumer Protection (UOKiK):
The availability of alternative dispute resolution procedures depends on applicable law and the circumstances of the dispute.
Nothing in these Terms limits the customer's right to bring a claim before a competent court.
15. Applicable Law
These Terms are governed by Polish law, subject to mandatory consumer protection rules that may apply to customers in other jurisdictions.
Any provision found to be invalid or unenforceable does not affect the remaining provisions to the extent permitted by law.
Nothing in these Terms excludes or restricts statutory consumer rights.
16. Changes to the Terms
Vintage Gear may update these Terms in response to legal, technical or operational changes.
Updates do not retrospectively alter the conditions of contracts already concluded or remove acquired consumer rights.
The version applicable to an individual purchase is the version made available to the customer before conclusion of the contract.
